Shipping

The terms and conditions apply for all purchases made on "Vanessa J. Lurtz" online store

 

Scope and parties

 

1- These General Terms and Conditions, valid at the time of the order, govern the relationship between Vanessa J. Lurtz, Schäringerstr. 22, 80634 Munich, Germany (the "Seller") and the customer (the "Customer") and apply to transactions in the online store (studio@vanessajlurtz.com the "Online Store"). The Customer can retrieve the General Terms and Conditions when placing an order via the links in the Online Shop or save them on his computer and/or print them out.



2- The following company provides customer service for the Online Shop on behalf of the Seller. The customer may contact this company with any concerns regarding the online store: Vanessa J. Lurtz, Schäringerstr. 22, 80634 Munich, Germany, studio@vanessajlurtz.com

 

Purchase of products
 

1- The purchase of products is subject to the terms and conditions in force at the time.


2- When you purchase a Product: (i) you are responsible for reading the item description in its entirety before making a binding purchase; and (ii) the completion of an order on the Site (by completing a payment transaction via the "Order for a Fee" button or similar button) may constitute a legally binding contract for the purchase of the relevant Product, unless these Terms provide otherwise.

 

3- The delivery of goods will be made only in household quantities. For business inquiries, please contact studio@vanessajlurtz.com.

 

4- After sending the order, the customer will receive an automatic confirmation of receipt by e-mail with a summary of the order data. This automatic confirmation of receipt does not constitute an acceptance of the customer's offer by the seller, but merely documents the receipt of the customer's order.

 

5- The binding purchase contract comes through confirmation of the order on the part of "Vanessa J. Lurtz" by a confirmation email.
 


6- If a contract is concluded, this refers only to the articles, which are mentioned in the confirmation.

 


7- If the customer, based on the selected payment method has already paid the purchase price before the conclusion of the contract, this also applies. If this does not result in a contract, the seller will inform the customer via e-mail and immediately refund the payment made.



 

8- The statutory right of withdrawal of the customer (see § 7) remains unaffected by the above provision.



9- The contract language is English. The seller stores a copy of the contract text. This consists of the order, the general terms and conditions and the contract confirmation. He also forwards these to the customer.

10- The presentation of the products in the online store does not constitute a legally binding offer, but a non-binding online catalog.





Delivery, delivery times, availability of the goods

 


1- Delivery is made within the EU with Hermes or DHL. The goods will be delivered to the customer at the delivery address provided the customer, unless otherwise agreed. Delivery to packing stations is not possible. The delivery time for standard deliveries within the European Union is up to 14 working days from order confirmation. 



2- After the goods are handed over to the transport company, the customer will receive an e-mail with a shipping confirmation from the seller and a tracking link, through which he can follow the delivery status of his order.

3- In case of a unavailability of goods, the buyer will be informed about the delivery terms. A subsequent delivery period will be agreed upon. If the seller does not deliver by the deadline, the customer may withdraw from the purchase contract.



4- Both parties are entitled to withdraw from the contract if the seller cannot meet the binding delivery date for reasons beyond his control. The following count as reasons: Unvailability of goods, due to failure of the Seller's own supplier to deliver or force majeure. The seller informs the buyer about this immediately and gives the customer if necessary a new expected delivery date. If this is unreasonable for the customer or if the goods are not or not completely available within the new delivery time, the customer can withdraw from the contract. The seller will refund the customer the already made payment. Possible legal rights of the parties remain unaffected.




 

Prices and costs

 

1- The small business regulation applies according to Art. § 19 Value Added Tax Act. Thus, no taxes are levied on the stated prices.


2- Shipping costs or additional costs will be communicated to the customer by the seller before placing the order on the order form. All prices stated on the Seller's site do not include taxes due to the application of the small business regulation pursuant to Art. § 19 of the Value Added Tax Act. Shipping costs may vary depending on the country to which the goods are shipped. The customer bears the notified shipping costs and any additional costs. The final shipping costs will be shown in the checkout process.

 




Retention of Title



 

1- The seller retains title to the delivered goods until full payment of the purchase price.
 


2- The seller accepts only the payment methods displayed during the checkout process.

3- In case of payment by credit card, the value of the order will be debited from the account after the order is completed.

 

3- In order to safeguard against the risk of the customer's default, the seller reserves the right to exclude certain payment methods in individual cases.

 



Cancellation policy



 

1- The customer can revoke the contract declaration or the delivery in any kind within two weeks without giving reasons and in original and undamaged packaging - by returning the goods. The shipping costs for the return of an undamaged item shall be covered by the customer.

2- The period begins after receiving this notification in writing, but not before receiving the goods by the customer (in case of recurring deliveries of similar goods not before receipt of the first partial delivery) and also not before fulfilling our obligations to provide information pursuant to Article 246 § 2 in conjunction with § 1 paragraph 1 and 2 EGBGB and our obligations pursuant to § 312e paragraph 1 sentence 1 BGB in conjunction with Article 246 § 3 EGBGB. Personalized items are excluded from return and exchange.


 

3- Consumers in the sense of § 13 BGB are entitled to a statutory right of withdrawal for goods purchased. The right of withdrawal does not apply to goods that have been custom-made for the customer.

 

4- The seller will refund the purchase price or exchange the goods if they arrive damaged. If you find your goods damaged upon arrival, please remember to take a photo showing how the goods arrived to you before writing to us.


5- Please note that the refund will be in the form of the original payment. Including delivery costs (except for the additional costs resulting from the fact that the customer has chosen a method of delivery other than the cheapest standard delivery offered by the seller).
